Massachusetts is a no-fault state. Every driver must carry Personal Injury Protection (PIP) coverage, which pays up to $8,000 per injured person for medical expenses and a portion of lost wages regardless of who caused the accident. PIP covers passengers as well as drivers and applies without regard to fault.

PIP has real limits, though. To file a bodily injury lawsuit directly against the at-fault driver, an injured person must meet the serious injury threshold under M.G.L. c. 231 § 6D: medical expenses exceeding $2,000, or death, loss of a body member, permanent and serious disfigurement, or loss of sight or hearing. When those thresholds are met, a tort claim opens up the full range of damages that PIP doesn’t cover.

Two additional coverage types are worth understanding early in a claim. Massachusetts requires drivers to carry a minimum of $25,000 per person and $50,000 per accident in liability coverage, though many carry more. Uninsured and underinsured motorist coverage protects you when the at-fault driver has no insurance or not enough to cover your losses.
