What Are the Benefits of Mediation?
Mediation is a process that enables you and your spouse to work out your divorce on your own terms and outside of court, with the assistance of an unbiased third-party. This mediator is an individual trained in conflict resolution and the law in order to help guide you and your spouse through an amicable divorce. However, a mediator can’t actually make decisions for you, so ultimately it will be up to you and your partner to come to a mutual agreement.
Mediation appeals to couples who are separating for many issues, including:
- Mediation is much more affordable than divorce court and hearings
- Mediation is private and confidential—it involves no public record of the proceedings
- The process is controlled by you and your spouse, not by the courts or a judge
- The parties involved can arrive at a resolution they believe is fair, rather than what a court dictates
- Mediation facilitates open communication between you and your former partner, helping you both to avoid future conflicts
- Most mediations end in a settlement resolving all the issues of your separation
However, mediation is not for everyone.
